Terms of Service
These terms are to protect the artist, and by working with me you are automatically agreeing to this TOS. Breaking these terms will result to a spot on a blacklist meaning I will not work with you again. The artist retains the right to change their TOS at any given time. BY SENDING PAYMENT YOU AUTOMATICALLY ACCEPT AND AGREE TO THESE TERMS OF SERVICE✰ ☽━━━━━━━━━━━━⋅·⊰ ◯ ⊱·⋅━━━━━━━━━━━━☾ ✰::General::- The Artist charges in USD only unless otherwise stated.
- The artist does not work with minors or anyone under 18+ unless they are accompanied by an adult. Any minor CANNOT commission a NSFW piece.
- Payment is due up-front before any work has begun. The artist won't start the commission until receiving an full payment.
- The artist will send a invoice via PayPal to the email provided upon commissioning. DO NOT send the payment as a gift.
- The artist reserves the right to refuse any commission for any reason, and is in no way obligated to provide a reason in the case of a refusal.
- The customer is free to post any commission done for them to a personal/public gallery as long as proper credit to the artist is given. The customer is not allowed in any way to remove the artist’s signature on any image. The customer has permission to alter, crop, and/or edit their commission for websites, banners, signatures, icons and so on provided that there is proper credit stated to the artist. The artist can withdraw this permission at any given time.
- When the artist’s personal life comes into place, it could cause mental stress or lack of motivation for the artist. The customer must be understanding and respectful of these occurrences. If the artist is feeling unmotivated to complete a certain piece they may bump a commissioner ahead of them to get the flow of motivation moving. Please take this into consideration, creativity takes time.
- In the event of illness, injury, or accidents the artist or someone associated with the artist will be in contact as soon as possible about rescheduling deadlines, cancellations, refunds, or other arrangements. Only the artist's contact information may be contacted.::Commissioning::You are a customer/client. The artist's goal is to provide the best customer service possible, within reason. Communication is a strong factor with their artwork and services. Please do not be shy to ask questions. You can ask as many questions as you seem fit as long as they are appropriate.
- Commission times vary depending on current workload. Commissions can take up to a month or more to complete. Please note that the artist will get to your commission in a timely manner. For the best artistic quality, consider allowing the artist some artistic freedom on your commission
- The artist works with character descriptions. Visual references of examples of a character are more so encouraged. When submitting an order, please be clear and to the point about what you're looking for.
- The artist can draw any animal, human or fantasy species. Also the artist can draw any body type, gender, etc. Please ask about what the artist will and won’t draw.
- The artist will offer a refund before any work has begun if the commissioner is dissatisfied, once work has been started however the artist will only refund a percentage portion of the funds. (See below)
- During any commission order , the artist will be contacting the customer involving sketch previews. When the customer receives a sketch preview, they must examine it and see if there is anything wrong or that needs to be corrected/changed. If the sketch is not what you had in mind, you must respond promptly with what you wish to have changed in an effective timely and professional manner.
- If you decide to cancel your slot: If it is a sketch (Or sketched) a full refund would be in order. If it is at the lineart stage, the artist would keep 20% (estimate) of what was paid. If it is fully colored and inked (depending on what was commissioned), 50%-100%(estimate) of the paid price would be kept by the artist. If you decide to cancel it when it is completely done, there will be no refunds whatsoever. Cancelled art will be turned into "YCH"s and be posted back up for sale or used in another commission.
- The artist is willing to change a sketch multiple times to the commission. Once the lineart is completed however, additional charges will be asked. The artist's process broken down step by step includes: 1) Sketches, 2) Lines, 3) Coloring, 4) Shading, 5) Detailing.
- Once the final WIP for an approval of posting is shown, it is the customer's job to point out anything that needs to be fixed. Once it is approved, posted and sent, there will be no more further fixing without charges.
- The artist will attempt to remain in contact with all parties involved to the best of the artist’s ability. It is also encouraged that all commissioners in a group commission consult with each other before contacting the artist through a single message. In the event multiple parties are involved, once a commission is completed it may not be edited to the degree of a change or replacement of a character, unless the commissioner(s) pay a fee, decided by the artist.
- The artist can work with deadlines. If it is for a birthday, con, or anniversary please inquire before ordering. If no deadline is set, it is understood that the artist will complete it in a reasonable amount of time determined by the artist themselves. Please note there will be an additional rush fee included if the artist can not meet a reasonable deadline.
- The artist cannot offer any refunds for collaboration work with other artists. Keep this in mind when purchasing a collab piece.::After a Purchase::- Unless the artist has stated otherwise, the artist will retain all copyright to their artwork, even when characters contained within the work belong to the customer. The artist will not contact a previous customer and ask permission to let their artwork of their character be distributed on digital or physical media, other than posting the art on the artist's online galleries. All characters are property of their respected owners.
- The artist will not make edits to a commission if it is not stated or requested when your commission is complete. (Don’t come back months later asking for edits unless you are willing to pay an additional fee.)
- The artist is free to post, or not post any commissions to their public gallery. The artist is permitted to alter, crop, etc. a commission they've created for advertising, etc.
- The artist reserves the right to make any of their artwork into prints for resale from (11-03-2023) going forward.
- Once a physical commission has been shipped it is out of the artists hands and out of their control. The artist is not responsible for lost mail.
- For mailing, the artist will not charge for a mailing fee for small items, such as badges or prints. For bigger purchases, (Example: A fursuit), the artist will be in contact for shipping costs.
- You may NOT use the artists work to make profit. This includes but is not limited to t-shirts, prints, stickers, logos, etc unless permission is given by the artist and a percentage of pay is given to the artist as well.
- Harassment of any kind will not be tolerated at any level. The artist will immediately cancel the commission and refund a percentage (depending on how much work has been done on the piece) if payment is received (Minus any work already done).::Other::- The use of the artist’s characters or other intellectual property without the artist’s consent is prohibited and will result in a spot on a blacklist; meaning you can never commission or contact the artist again and known parties will know of your actions.
- Any false claims of ownership of characters or artwork will result in a cease and desist and legal action. This is to protect the artist, the customer, and all works produced.
-Do not use PayPal disputes to get a refund, the artist will be in contact with the client for a refund. Opening disputes endangers the artists livelihood by putting their PayPal account at risk of being limited or even frozen. Anyone opening disputes against the artists PayPal account will be placed on their blacklist permanently.
-All contact and personal information will not be sold to or shared with any third party’s. All instant messages, SMS, emails, screenshots, and audio, video, screen capture recordings will not be shared unless used as proof of contract. As well as, but not limited to, all current or future forms of communication, will not be posted online, unless used as proof as contract. This excludes comments posted or anything said during a group chat, stream chat, or interactions on public networks and social media that is publicly viewable. In the event you receive mail with the artist’s address and/or personal information it is agreed upon that you DO NOT SHARE this information. Sharing this information with any kind of intent is against this T.O.S. and will be dealt with legal action. A line of communication will be established with the commissioner and the commissioner only. This is to ensure privacy is kept with the party to receive updates and progress reports. Any other parties that attempt contact for request about the commissioner's commission(s) will be recorded and ignored.(Updated as of 3-11-2023)
